Winchester City Council Recount Petition Dismissed

A petition for a recount in the Winchester City Council Ward 4 election has been dismissed by a judge due to a breach of procedure.
Republican candidate Debera Taylor, who lost on election night by just three votes and was therefore entitled to a recount, had 10 days to file and another 10 days after that to have her petition served to opponent Judy McKiernan. However, due to an oversight by the Winchester Circuit Court Clerk’s Office, it appears the petition was never mailed to McKiernan. Taylor’s lawyer has characterized the dismissal of the recount as “not fair,” and said Monday that a November 23rd front page article in a local outlet should have served as formal notice to McKiernan. While Judge Bruce D. Albertson disagreed, his decision will be reviewed by two other judges; if it is overturned, a date for the recount will be scheduled Friday afternoon.
